If you cannot remember your secret question and the answer, go to this page: https://www.google.com/support/accounts/bin/request.py?hl=en&contact_type=acc_reco&ara=2&ctx=acc_reco&rd=1. Check the "No" box there. This will indicate that you were unable to access your account using the above mentioned methods. The form is short and straightforward. This will also let Google ascertain that you are the true owner of your account. It will also tell you the exact time your account was hacked.

Unfortunately, this is your point of having a lawful option. If you do not have a secondary email address, you should provide one.
