'Duck Dynasty' Robertson Family in Legal Battle over 'Camo' Gear, Read More Here
"Duck Dynasty" became one of the biggest shows on television the last few years, but 2014 hasn't been too smooth for the Robertson clan. Their television ratings have steadily been slipping over the past few seasons of their show on A&E and now they have another legal battle on their hands.
Uncle Si Robertson announced, "My favorite color is camo" on an earlier episode of "Duck Dynasty" and the phrase was soon sold everywhere on t-shirts and hoodies, bringing in big money.
The show then promoted it on social media (July 7, 2013) : @DuckDynastyAE "#Camo is my favorite color. #duckdynasty #philrobertson"
However, a lawsuit was just filed in Florida and A&E and the Robertsons might have been participating in trademark infringement.
The plaintiff is a company named Hajn, and they have been selling a line of apparel that's branded, "My Favorite Color's Camo." The company has a registered trademark and reports gaining national visibility with its mark.
According to the complaint (read here), A&E with Wal-Mart alone is said to have generated $400 million for A&E last year. A&E used Robertson's "My favorite color is camo" line on clothing, states the complaint. A&E is now being sued for trademark infringement and unfair competition. The plaintiff demands an injunction and an unspecified amount of monetary damages.
Hajn says that A&E never responded to a cease-and-desist letter.
"A&E's use of the name has led to instances of confusion, including instances of reverse actual confusion, in that customers either believe that Hajn is selling Duck Dynasty apparel, or that Hajn's apparel and related novelty goods are based upon the show," says the lawsuit.
